2. Eligibility and Age Requirements

By using our Websites or Service, you confirm that:
• You are at least 13 years of age. If you are under 18, you must have the consent of a parent or legal guardian to use our Websites and Service.
• You have the legal capacity to agree to these Terms.
• If you are using our Service on behalf of a business or organisation, you have authority to bind that entity to these Terms.

 

Our Service is not directed at children under 13. If we become aware that a person under 13 has used our Websites or provided personal data without appropriate parental consent, we

Our Websites are designed primarily to allow you to access, view, download, and share GIFs and images produced at our photobooth installations. You may use our Websites for lawful personal or business purposes in accordance with these Terms.

You agree that you will not:
• Access or attempt to access images of which you are not the subject, unless you have the explicit permission of the individual(s) depicted in those images.
• Upload, share, or distribute any explicit, offensive, defamatory, discriminatory, or otherwise unlawful content.
• Use our Websites to harass, threaten, or harm any individual.
• Attempt to gain unauthorised access to our systems, servers, or other users' accounts.
• Use automated tools (including bots, scrapers, or crawlers) to access or extract content from our Websites without our prior written consent.
• Introduce malicious code, viruses, or other harmful software to our Websites or systems.
• Reproduce, redistribute, or commercially exploit any content from our Websites without our prior written consent.
• Use our Websites in any way that could damage, disable, overburden, or impair them.

4. Conduct at Our Photobooth Installations

When using our photobooth installations at venues, you agree to:
• Use the booth in a lawful and respectful manner.
• Not capture or attempt to capture images of individuals who have not consented to being photographed.
• Not tamper with, damage, or attempt to modify the photobooth hardware or software.
• Not use the booth to produce any content that is explicit, offensive, or unlawful.
• Comply with any additional rules or conditions imposed by the venue at which the booth is located.

Bar Booths Ltd reserves the right to remotely restrict or disable access to photobooth features where misuse is suspected or identified. Damage to our equipment caused through misuse or negligence may result in costs being claimed from the responsible party.

5. Intellectual Property

5.1 Our Brands and Content

The Bar Booths Ltd and Snap-O-Matic trademarks, logos, trade names, and website content are the intellectual property of Bar Booths Ltd and are protected by UK trademark and copyright law. You may not use any of our trademarks, logos, or branding without our prior written consent.

5.2 Images Captured at Our Photobooths

All photographs, GIFs, and other images captured by our photobooth systems are owned by Bar Booths Ltd. By using our Service, we grant you a personal, non-exclusive, non-transferable licence to access, download, and share your own images for personal, non-commercial purposes.
This licence does not permit you to:
• Sell, sublicense, or commercially exploit images captured at our booths without our prior written consent.
• Remove or alter any branding, overlays, or watermarks applied to images by our systems.
Where venue partners have separate agreements regarding image rights, those agreements will take precedence for the images produced at their venues, subject always to our Privacy Policy.

 

6. Payments and Refunds

6.1 Payment Processing

Payments made at our photobooth installations are processed by Nayax and/or myPOS. Payments made through our Websites (including for print and reprint orders) are processed by Stripe. All payment processing is subject to the relevant processor's own terms and privacy policy. We do not store your full payment card details. All card data is handled directly by our PCI-DSS compliant payment processors.

 

6.2 Print and Reprint Orders

Payment for print and reprint orders placed through our Websites is taken in advance. Orders will be fulfilled following receipt of cleared payment.

 

6.3 Refund Policy

We will issue a refund for print or reprint orders in the following circumstances:
• A genuine fault in the product is identified (e.g. a printing error or quality defect
attributable to us).
• Your order was not delivered and non-delivery has been confirmed.
We are unable to offer refunds where the order has been correctly fulfilled in accordance with your specifications, or where any issue is attributable to incorrect information provided by you at the time of ordering. To request a refund, please contact us at support@snapomatic.co.uk with your order details and a description of the issue.

 

7. Links to Third-Party Websites

Our Websites may contain links to third-party websites or services. These links are provided for your convenience only. We have no control over the content, privacy policies, or practices of any third-party sites and accept no responsibility for them. We encourage you to review the terms and privacy policies of any third-party sites you visit.

 

8. Disclaimers and Limitation of Liability

8.1 Service Availability

We aim to make our Websites and Service available at all times, but we do not guarantee uninterrupted or error-free access. We reserve the right to suspend, withdraw, or restrict access to all or part of our Websites or Service at any time for operational, technical, or commercial reasons, with or without notice.

 

8.2 Disclaimer of Warranties

To the fullest extent permitted by law, our Websites and Service are provided on an "as is" and "as available" basis without any warranty of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, or non infringement.

To the fullest extent permitted by applicable law, Bar Booths Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of our Websites or Service, even if we have been advised of the possibility of such damages. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited under English law.

By using our Websites or Service, you consent to the collection and use of your data as described in that policy.

10. Termination and Suspension

We reserve the right to terminate or suspend your access to our Websites and/or Service immediately and without prior notice or liability if:

• We are required to do so by law or a regulatory authority.
• We reasonably believe your use of our Websites or Service poses a risk to us, other users, or third parties. Upon termination, your right to use our Websites and Service will immediately cease. 11. Dispute Resolution

We aim to resolve any concerns or complaints quickly and fairly. If you have a dispute arising out of or in connection with these Terms or our Service, please contact us in the first instance at support@snapomatic.co.uk so that we can attempt to resolve the matter informally. If a dispute cannot be resolved informally, the parties agree to attempt to resolve it through mediation or, where appropriate, arbitration before pursuing litigation. Nothing in this clause prevents either party from seeking urgent injunctive relief from a court of competent jurisdiction.

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms, subject to the dispute resolution process set out in Section 11.

Where changes are material, we will provide reasonable notice by  posting the updated Terms on our Websites and updating the 'Last updated' date at the top of this document. Your continued use of our Websites or Service following the posting of any changes constitutes your acceptance of the revised Terms.We encourage you to review these Terms periodically.

 

14. Severability

If any provision of these Terms is found to be invalid, unlawful, or unenforceable by a court of competent jurisdiction, that provision shall be deemed severed from the remainder of the Terms, which shall continue in full force and effect.

These Terms, together with our Privacy & Data Protection Policy and any other policies or notices published on our Websites, constitute the entire agreement between you and Bar Booths Ltd in relation to your use of our Websites and Service, and supersede all prior agreements, representations, and understandings.
